General
By using our services, you agree to comply with our Terms and Conditions and Data Privacy Policy – collectively referred as Terms – and to be legally bound by them.
FairestBnb enables hosts and volunteers to connect with each other. You agree that FairestBnb is not part of any agreements between hosts and volunteers, nor is FairestBnb an agent, insurer or exchange organisation. FairestBnb does not monitor or control hosts or volunteers and disclaims any liability in this regard.
Under no circumstances can we refund the service fee once it has been paid. You agree to indemnify FairestBnb against any claims, actions, proceedings, losses, damages, expenses and costs (including court costs and legal fees) arising out of or in connection with your use of FairestBnb.
Eligibility
In order to use our platform, you must be an individual at least 18 years old and are able to enter into legally binding contracts.
Scope
You acknowledge that FairestBnb is a service to enable bookings and does not act as an agent or part of any exchange you organise.
We do not screen the identity of any hosts or volunteers and you are solely responsible for ensuring that any person you accept is who they say they are. You are fully responsible for investigating whether your chosen host offered accommodation and opportunities are suitable for you and your needs or whether the volunteer offered skills meet your requirements. FairestBnb does not guarantee the quality of any skill, offer or accommodation. In order to duly complete and secure your booking, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number. All the information on our platform provided by the host and the volunteer are their responsibility.
FairestBnb disclaims any liability or responsibility for any communication on or through our platform. You cannot derive any rights from any request to, or communication with the host or volunteer, or (any form of) acknowledgement of receipt of any communication or request. FairestBnb cannot guarantee that any request or communication will be duly and timely received, read, complied with, executed, or accepted by the host or volunteer.
You acknowledge that if you were to seek any legal remedy for actions or omissions of hosts or volunteers, or any third parties, you will not claim any liability against FairestBnb.
FairestBnb may contain links or references to third party websites. We have no control over third-party websites and accept no legal responsibility for any content, material, or information contained in them. The display of any link or reference to any third party website does not mean that we endorse that website, product or service.
Registration and Obligations
Registration is necessary to access and use certain features of FairestBnb, such as publishing or booking. If you register on behalf of an organisation or other legal entity, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.
You must provide accurate, current and complete information during the registration process and keep your FairestBnb account and profile page up to date at all times. You are responsible for maintaining the confidentiality and security of your account and may not disclose your credentials to any third party. Therefore you are liable for any activities conducted through your account.
As part of your registration, you grant us a non-exclusive, transferable, sublicensable, royalty-free worldwide license to use the photos and information on your listing or elsewhere in connection with FairestBnb. You also warrant that you are licensed to use the photos on your listing and our use of the photos will not infringe the rights of any other person or organisation.
You are solely responsible for complying with the relevant rules and laws in your jurisdiction, especially with regard to taxes, insurance, and visas. You must also be tolerant to ways of living and be sympathetic with the culture of the particular country and any rules set by the host.
When hosts turn on “Require approval” they agree to accept (or decline) booking requests within 48 hours. Volunteers agree to finish the booking after confirmation of the host within 48 hours. When hosts turn off “Require approval” they agree to accept instant bookings.
FairestBnb reserves the right to edit and remove your account or listing without warning if we believe (in our sole discretion) that it infringes or violates our Terms, another person ‘s rights or any laws in any country. It is not allowed to set up a new account.
Conduct
By using our services you agree that you are solely responsible for compliance with any law, rule or regulation that may apply to your relationship with any host, volunteer or any third party.
You acknowledge that you will not
- violate these Terms, any law or regulation or any order of court;
- use FairestBnb for illegal purpose, especially to breach violate FairestBnb or these Terms;
- use FairestBnb, collect or retrieve our data for commercial purpose without our permission or purposes that violate these Terms or any law;
- harm the reputation, brand or image of FairestBnb in any way, including through unauthorised use, infringement of FairestBnb ‘s intellectual property rights, passing off, registration or use any identifier that would create a confusion with FairestBnb or imply a connection with FairestBnb;
- offer a volunteer an accommodation without any permission or authorisation or submit any listing with false or misleading information.
Misconduct
The intention of FairestBnb is to provide a fairest transaction between hosts and volunteers, therefore you are not allowed to ask payments for the provided help or accommodation.
If you feel someone is acting inappropriate and is violating the Terms, you should immediately if applicable, report it to the appropriate authorities and inform FairestBnb.
Safety
You acknowledge that FairestBnb is not, in any way, responsible for guaranteeing the safety of any hosts, volunteers or any person associated with either of them.
Service fee
FairestBnb charges the volunteers a service fee for the booking. Any applicable fees, including any applicable taxes, will be displayed prior a booking. FairestBnb reserves the right to change the service fee at any time. Such changes will not affect any bookings made prior to the effective date of the fee change.
You authorise FairestBnb to charge the total fee for any booking made in connection with your FairestBnb account. The total fee will be collected after your booking.
Please note that payments may involve the use of third party payment service providers. These service providers may charge you additional fees when processing payments. FairestBnb is not responsible for such fees and disclaims all liability in this regard.
Except as otherwise provided, service fees are non-refundable. Even if a booking is cancelled by the host or the volunteer before the stay takes place. Both of you are responsible for the communication and solution for any financial loss. FairestBnb is not party or will not intervene in this matter in any circumstances.
Disclaimers
This website has been compiled with great care. Nevertheless, no guarantees can be given with regard to the completeness, correctness or topicality of our information or of information from third parties on our platform. FairestBnb cannot be held liable for the content of this information or for the consequences of its use. No rights can be derived from the data as shown on our platform.
Modifications of these Terms
FairestBnb reserves the right to retract or modify these Terms at any time without notice or refund. Accordingly, you should check the Terms and Conditions regularly for updates. You can determine when the Terms and Conditions were last revised by referring to the “Last revised” legend at the bottom of this page. Each time you access, use or browse the
website, you signify your acceptance of the then-current Terms. Any changes in these Terms take effect upon posting and apply only to use of the platform and information collected from you on and after last revised date, unless we provide notice or have other communications with you.
These terms and conditions and the provision of our services shall be governed by and construed in accordance with the Dutch law. Any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in The Netherlands.
